but from u.s.a.i recieved visa for only 3 months but i stayed here last 8 months,now i want to leave so will i face any kind of problem or will my visa be cancelled due to staying for longer period.i hope u will help me out with my this problem. thanking you....

yes .. u will face a problem, since everything is computerised and after the 9/11 security is at its peak u will be traced out easily..

even i have a 10yr multiple and a B1/B2, i get to stay 6 months at port of entry, everytime i visit and have come back on the last day of my expiry of visa and returned again after a couple of months. I have not had any problem... guess u should have done something like that. About ur visa getting cancelled, am not very sure for when i had asked the same question as urs , i ws told that if u breach the contract of ur stay and overstay without a valid reason or prior permission then the visa even though valid for 10yrs will be cancelled...

You breached the conditions of your B1/B2 visa which states that you cannot stay for more than 6 consecutive months per visit you make. You stayed for a consecutive 8 months; you will have problems the next time you seek entry to the USA. This is because with your I-94 they can track your entry and exit into USA and they will know you breached your visa terms and conditions.

Even if you don't turn in your I-94, there are computerized chips in all passports made since october 2002 in all countries in world. However, international flights are required to collect all I-94s from passengers before the passengers board the international flights.

Also, when airlines and immigration officers scan your passport to verify that you are a passenger on an international flight, the records go straight to the immigration dept. and they will still know you breached your visa terms, the next time you seek entry into the USA.

See a good lawyer, if you want to come to USA again, you should have stepped out of USA. Or asked for extension under hardship condition. What kind of hardship you had?
