I am wondering can my husband move out of the house and not making payment toward the house that we both share plus other expenses? He just moved out and took most of the money. And said that he is not going to help me with the house payment and other payment such as credit cards . Thanks

We both live in TX. The house is under both of our names. He also said that he will begin to pay child support on 1/15 even though he said he doesn't have to until order by the court. Should I accept this since I haven't been served with divorce paper? Thank you all for your help. I really appreciate it.

Get a good lawyer. My Ex Husband had to pay all the credit card dept and for the house. A good lawyer is worth their weight in gold

Oh man, he is in for some trouble.
Whatever Loans you have with him that are under BOTH of your names, then you BOTH are responsible for the payments. Keep making whatever payments possible that you are able to make (the minimum, the better) only because WHEN you take him to court (civil court if not divorce court) you WILL look so much more responsible. Believe me, the judge will favor you over him. He will have to pay you and/or the company for any charges that has incurred since he stopped paying his part.
Get yourself an attorney or take him to civil court!!

If I were you I would check with an attorney about that. There should be attorneys around that won't charge you anything for the first consultation.
But as far as I know from my divorce, we each had to pay our own bills that were in our own names, then the bills that were between us we had to split the bills between us.
As for the house payment he will either have to make it or you'll have to put the house up for sale and split the money.

Depending on what state you live in you need to go get a separation agreement or a divorce because anything that you two have together depending on the divorce will have to be devided. but as far as the separation depending on how you go about it you can go to court as you would do a divorce and they will make him help you. Plus set up child support if you have children.

He can, until you see a lawyer, it has to go to court to be approve by a judge, only then will he have to pay.....God bless ya
