If you are in fact separated and are not yet divorced, neither of you are allowed to take the children out of the state. It states that on the back of both subpoena that clearly states if either of you take the children out of the state that it be consider "kidnapping". The best is to get a journal that you wright in everyday even if nothing has happened it might so also help you if you guys have to battle it out in court. Good Luck and always remember that this is not just the 2 of you but more importantly about your children

If you don't have a temporary order of custody, yes she can. As long as both of you are married, you both have equal access to the kids. You could take your son out of state and she could take your son out of state. If divorce is the road you're traveling, be sure you get an attorney involved and you have a predivorce exit plan in place.

She is not supposed to do that but I would reccommend that you try to work through it.

Trickier question would be was child born there. DId she move pregnant?

She may not have the funds to support herself or child so what are you going to do force her to live in a cardboard house? You guys have twenty years that you need to have a working relationship with (until child grows up) so try to work it out.

well technically she cant but since she didn't keep it a secret u probable should have spoken up before she done it.let your ex know that u all need to discuss joint custody issues and tell her how u feel about the move.i commend u for wanting to be in your kids life because a lot of men wouldn't give a damn

It depends if you are legally seperated or not. If your not legally seperated by a judge, she can take your child anywhere she wants. Been there and experienced that.

Yes, she can but you all need to get a divorce and finalize the custody of your child.

yes, she can seeing how you are just seperated and there has been no custody order, you need to see a lawyer and file for custody before she does.
