The lease is up at the end of the month. My boyfriend went out of town, and told her that I would need some time to get my stuff out, and she said that was fine. I came back (I was out of town too) on the 2nd. All of our stuff has been moved from the main areas into our room, so she has room to pack her stuff up. The only stuff left in the open is our food and the Christmas tree. I haven't put anything in boxes yet because I've been working from 8am to 9pm. I was planning on packing everything up today and tomorrow (the 6th and 7th) but the lock had been changed! The apartment is in her name, and we have no lease with her, but all of my things are in the apartment, and I need them. I have been trying to call her, and I went to her house (she doesn't really live at the apartment; she stores her stuff there) and I can't get a hold of her. I am waiting until tonight, in case she is at work, but if she won't let me in, what can I do? Is this in anyway my fault? Thank you!

Also, we haven't paid her for January, because I was just staying a short bit to get my stuff. She said this was fine.

That is called a lockout and is illegal, you can take her to small claims for that.

Lockouts – The law prohibits landlords from changing locks or adding new locks to keep a tenant out, even if the tenant is behind in rent. A tenant who is locked out can file a lawsuit to regain entry.

And plus your lease is up at the end of the month, you should be able to get your stuff.

If the lease is not up until the end of the month than she can not lock you our provided that you paid your rent! Since you have no lease the law calls it month to month! I would go to the police station and ask for someone to go with you and explain no one is thre. If anything it will leave a paper trail that you did try just incase you must go to sm. claims court Seen this one one of the court shows!

If your friend owns the apartment and you had no lease, then you don't have anything legal to back you up here. You can prove in court that you were paying her something if you have cancelled checks - but that doesn't get you into the apartment. It would be illegal for you to break in to retrieve your belongings. Your best bet is to wait for her to contact you.

As the lease holder, she has the right to lock you out if you dont pay. However, those things are still yours and even if you have to go to your landlord, go, thats still your property.

talk to her...then police.....then go to court if she keeps doing this
