My husband was arrested yesterday for VOP. Police stoped him for a traffic ticket and found out he had a warrant from another county (miami, FL) we understood this was already over more than 5 years ago. After 100 calls I came to find out that he was still owing 250 dollars for some charges of his restitution amount. I paid it the same day, yesterday. He is still in the county jail we live waiting to be picked up by miami and see the judge. He does not owe any money,it was all a mistake, we never receive a letter stating that he still owed the money. Any way what will happen to him? Will the Judge let him go? His probation was for 2 years but if he paid all the money he owed it was over. Please advise I am going crazy. thank you

My husband has not incurred in any other violations or crimes. His VOP is because they say that he failed to pay the last 258 of the restitution money. I paid it the same they we found out and he was arrested. Now he doesn't owe anything. Will the judge let him go?

Since probation requires the defendant to remain arrest and conviction free for the stipulated time, the prosecution may move to set aside his probation and have him resentenced. What happens in court is entirely up to the judge and the prosecutor.

unless you have papers from the State to show your man is no longer on paper, or that the fines are paid, this will continue.
The police are just doing their job, and the Judge will sort through it.
Untill monday, there is not much you can do, but monday morning, be at the court hearing with any and all paperwork.

P.S. Take along any stipulation orders on his probation with you.

Laws vary from state to state. this is definitely a "ask your lawyer question." FL is probably the last place I would want to get in trouble with the law.
