Can a repair shop keep your car and charge you storage and they could not fix the problem,then take your tag off the car and say you have abandon your car?What can we do time is running out. The story is my Son had it towed to the repair shop by the same repair shop and then was told that it could not be fixed. When he went to pick up the car he was told that they were charging towing and repairs.They said they could not fix it and was never sent anything in writing to this effect.Now they have taken the tag off the car and said he abandoned the car which is not true. He has been trying to work with the owner. The owner says he wants all fees for storage ,attempted repair,and towing, and if he does not get it he is going to put the car up as abandon because of non payment of his services. Is this legal and what can be done? Please help time is running out.What are the laws in Georgia. Thanks

i owned a repair shop in Texas and found out the hard way that threes no such thing as a mechanics lien in any state in the us.i know that in TX,AZ,CA,NJ, if you owe money to a shop and don't want to pay that's a civil matter.if a shop has your car and refuses to give it back that is a criminal charge.i would suggest calling the police and have them meet you at the shop,then insist on the return of your car.also removing your plate is theft.regardless of any money owed that car is legally yours and the louder you speak and the more fuss you make the better your chances are. good luck

He has to pay for the towing and storage. Even tho they could not do the repairs he still owes them for looking at it. I am not sure about the laws in Georgia but in Illinois they can put what they call a mechanics lien on the car for all unpaid bills.

If the owner of the vehicle entered a verbal agreement or a written agreement with a representative of the shop, yes they can place a a mechanics lien on the vehicle. Its kinda cheezy, and the shop will not be in business long.
Talk to the police and get your car back.

File a law suit. They are totally wrong. But, do it before one year is up. IOW, do it NOW!
