Can any new government (in '08) vote down or declare illegal, or whatever you would label it) the "Patriot Act" for example? and the president's authority to open mail wthout a warrant?

Two different things.

A new Congress could repeal the Patriot Act.

The 'authority' to open mail as I understand it is based on Bush's SAYING he has authority to do that. That may need the Supreme Court to intervene.

Yes.The patriot act is a a series of laws passed by Congress.They can rescind them just as easily.

They can, but they won't. They will use the authority to their own advantage.
