Ask yourself the following....
1. Do I want to put my product on the supermarket shelf or frozen food section?
2.Do I want to sell to consumers or food service professionals?

Depending on the state, your state should have a specialty foods or fine foods association made up of the fine food companies of your state. They are a tremendous resource for aspiring fine food companies. Find them and attend the meetings and conventions to make new contacts and learn. As for patent that will depend on how you decide to market. You can patent your recipe, however it is relative since someone else proably has the same recipe in their home kitchen. The good thing is that they are not looking to market it to consumers. Recipes flow all over the place so to have an exclusive recipe is rather difficult. But don't worry just do your thing. As for licenses, that will depend on how your company is structured, the mission of your company and who your market is. Ask yourself will you work out of your home kitchen or out of a commercial kitchen? Will another company do the production of the product? Will they only can or bottle or create as well? Lots of work, I know, however if done correctly the reward can be great. One of my former board of directors member started her company in her home kitchen and now she is huge, here are some websites about her

When you are making food to sell, you have to have a license. The license is to show that you are following certain regulations to make and serve the food. Things like stainless steel kitchens. Get a license and then bring some of your wife's best dishes to your local farmer's market or if you happen to have a lot of spare moolah, open a restraunt or a cart that will sell your goods.

Companies usually don't use outside products. They hire people to create new recipes and products.

I knew a couple who work for Sarah Lee, designing bread as their job.
