He could. TNA offers a lot of benefits in terms of having a lighter schedule with less travel, so if he ever did get back into wrestling, he could work for TNA and not have as many conflicts in his schedule for his band.
On the other hand, he still seems to have a good relationship with WWE, and may not want to tarnish that.
Of course, he might not ever come back to wrestling.

No. The reason being that Chris Jericho has promised Vince McMahon that when he returns to wrestling, it will be in WWE. Of course, things could change but probably wont.
TNA are Jericho are really close, though, but as for now he seems more interested in enjoying life and the money he's made thru wrestling, plus focusing on his band, Fozzy.
