My wife was forced to quit her job a week ago because she refused to go into the smoking room to do 100% of her job... we just found out that we are having another child and dont want to risk the babies health, so she went to the manager and he said she had to quit, give two weeks notice (while still going into the smoking room) or stay till she is about to pop and come back after the baby is born.... i have heard that some people have been able to get upto or more than 20,000 dollars. and could get the company into trouble for this.
please help me with any information....

from what I understand.. when a women is pregnant the work place where she works has to find "safe " work for her it's the law .. I had a few problems when I was pregnant with work and screwing me around when I was pregnant and I called head office and told them everything and they freaked and said that they would handle it and they did... if they didn't do anything I was going to go to the labour board ... tell your wife to call the labour board right away and tell them everything because that is BS .. she should not have to work in a smoking room especially while pregnant .. with all of the studies that show how bad second hand smoke is .. call the labour board !!

i have never had a problem with this, but i am familiar with the system. you need to contact a lawyer and tell him the story and then he will do his job and she will get her job back. if he is an a$$hole then she will have to go to court about it an so forth. or he could be a softy and think of his chances of winning in a legal battle and realize that he would shell out more money than it is worth to him and give her her job back hope this helps, holly

You need to contact OSHA. If your state has a law banning smoking in workplaces or they agree the smoke would be harmful to your wife then yes.. they can be FORCED to give her her job back and comply with the rules or face penaltys.

It's illegal to force someone to quit especially since she's pregnant! You should contact a lawyer immediately and ask if they will do it on a contingency based fee (if you don't have money) You realize you are looking at some big money for that.

first, contact the labor board,,,, then she should also file for unemployment ,, if she qualifies,,,,, a smoking room is not a healthy environment, for anyone, especially a pregnant woman,,,,, there are laws about this, if you live in the USA,,,, if in another country, check the laws there,,,,,,,,
