my ex husband and his wife are facing three counts of child neglect each. they plead no contest to the cps hearing but are taking the criminal charges to trial. what can happen? would they possible see jail time? this happened in the sate of wisconsin

they children were removed but then returned 12 days later. because the home was repaired and they agreed to seek counseling. this is not the first contact with social services the were reported for abuse of several types but they could never prove anything before this one on trial.

They will be judged by a jury of their peers. They need a good lawyer.

Were the children removed from their custody? If so, they are appealing the decision & need an attorney. They'd better have a darn good case. If the children haven't been removed then it is likely that they will be. Whether they see jail time depends upon the county/state & the judge assigned to the case. Depends on how bad the neglect was.

No matter what state, unless this was an aggravated situation CPS will probably back out. Their standard operating procedure is to use threats and fear to justify their existence. Most cases are either dropped of dismissed by a judge. They do need a good attorney in any case.
