If both parents are good parents (don't commit crimes, etc.) most courts would let the child choose. A parent could go to court over it, but it probably wouldn't do any good if the parent the child chooses is a decent person.

I believe the courts can leave that decision up to the child at that age. My husband was 9 when his parents got divorce and he got choose which parents.

States will vary, and when I got divorced my children were 9 and 11 and they got to choose, and I have had sole custody of them for 6 years.

Depends on which state you live in. Each state sets different age requirements. I would think that most states would allow a 13 year old decide.

in most states a child of 12 can petition the court with their own choice of parent...... you can at the divorce hearing, IF the custody hearing is at same time, and ask the judge to hear you on this issue... if the custody hearing is seperate you can make your choice known at that time, then the judge may call you into his/her chambers for a talk........
