My brother lives in Ohio and like myself he is into turtles. The law is that you cannot sell a turtle of any species if the carapace is under 4 inches in length. It is not illegal to own them just sell them. I have several female red eared sliders that are used to breed for restock programs through out Mass. So every year i have lots of baby turtles under the legal limit. But because I do not sell them I can legally have them in my possesion. I have spoken with the Enviromental Police Department in West Boylston Mass and they say the same thing

Its illegal to sell them or at least sell them small in most of the States and Canada. Unfortunately many pet stores don't care or don't enforce that. If you see them, or see them small, complain to local wildlife officials.
And as a side note, your turtles will carry disease at any size if you don't keep them properly. The more damaging effect is people who buy them little then let them go when they get biggish (over 4 inches). By let them go I mean put them out in the wild, as an introduced species to mess up the local ecosystem.

Federal law prohibits the sale of RESs under 4 inches long unless for educational use. The only way anyone can keep them on display is if they have a permit.

I not too sure about that..but what i do know is that it is illegal to sell red ear sliders at a young age as they are know to carry a dangerous amount of salmonella which is a deadly disease.
