I am betting someone at work $100 that he can't drink a whole bottle of everclear. He says he can, but I know he is full of ****. I told him that $100 says you can't. I am even going to supply the bottle for him. I bet that he can't drink the whole bottle without puking or hitting the floor. If he dies of alcohol poisoning, could I be charged with murder. Would I be help accountable for him dying if I supply him the bottle and do nothing to stop him from drinking it all. He is 21 years old.

This is a complicated question and would make an excellent law exam. It could go either way

1) You can be charged with murder or manslaughter if you had a legal duty to rescue your friend but didn't this can be established through a)marriage b) parent/child etc. Under that you couldn't be charged. But by providing the botttle and making the bet you knowingly put him in danger....so if he were to get sick the prosecution would have a pretty strong argument that at that point you had a duty to rescue him by at least calling 911.

Other then that it would be hard to charge you because it would be his act (drinking the bottle) that caused him to be sick.

Since the outcome of your actions was forseeable, you would either be guilty of manslaughter, or reckless endangerment. Your jail time would be mitigated by the fact that he willingly drank the everclear, but you would still go away for a few years. Hope that risk is worth $100 to you.

he's not going to die, he's going to vomit. A LOT.

anyway, if you dare him to do it and you know there is a substantial risk of death from alcohol overdose, you had bettere be ready to call 911. Actually, i would probably recommend taking him to the ER before he begins drinking. just do all your stuff right there in the parking lot.

anyway, if he loses consciousness or the ability to care for himself, you will likely have a duty to try and get him help. however, as long as you are not completely incompetent in your attempts to render aid, its not your fault if he dies. but you could still be civilly liable for wrongful death under a concert of action theory.

so, basically, i recommend staging your little event not to far from a place where he can get his stomach pumped.

or you could grow up and act like an intelligent human being and not try and get other people to do things you know perfectly well are very dangerous. just a thought.

YES! First of all, why the heck would you do that to someone! YES, he could die and YES you would be held accountable! I guess, you find out the hard way. You are definitely a guy, b/c a girl would not be that ignorant! Grow up!

His death could be ruled as, "Death by Misadventure". It would be better to not go through with this one . . . possibly being charged with manslaughter just isn't worth winning a bet.

This is so childish. If he dies, I would not hold my breath as for as being totally innocent. There is always a law that can be used if the law wants someone arrested.

yes you would be held accountable for it, manslaughter to be exact, if there is witness present....2nd u only made a bet, u didnt force him to drink it. he's 2,1 he's legal and he has a mind of his own. he knows better than to do something so stupid.

Wow he is really going to die. LOL just try not to laugh. I really don't think that they could charge you with murder especially if he is the one who is dumb enough to try and drink it all.
