A mason was working on my neighbor's house and asked me if he could do some work for me to. As I was leaving for work, he said that he was almost done except for some touch up that he would finish the next day and would really appreciate getting paid immediately, because as he had mentioned earlier his wife is in the hospital getting a hysterectomy and he has to pay a bill soon . I gave him the full payment. Less than half the work was done and he does not answer any phone calls. My neighbor reports a similar experience. The worker even borrowed a couple of my things and seems to have taken some other items as well. Can I say sue him without an address or prevent him from conning other individuals by reporting him to something more than just the better business bureau? Do banks have any process through which checks to dishonest fly by night repair men would be delayed in clearing after proper police and other paperwork is filed? Any advice would be very appreciated!

It is going to be hard to track this guy down in order to sue him, because to sue him you'd have to have court papers served to him; if you don't know his location, it's going to be hard. You could hire a PI to track him down using the cell phone number and name; it's going to be costly, though.

However, if you wrote him a check you are in luck because you can tell your bank to put a stop payment on it. The bank will obviously charge you a fee for this, however the guy won't be able to get a cent of your money. You better move fast, although you could be too late, if he cashed the check at the counter at your one of your bank's branches.

If he deposited it into his account, then you may just be in time for the stop payment to take effect.

Search your state's department of consumer protection website to see if you can find his license number by his name. Buy all of your local newspapers and scan the classifieds to see if he is placing ads, with some effort that could lead to him. Contact an attorney by phone, many will offer some preliminary advice for free to let you know if you have a case (they are motiviated to find a way to sue). Good luck!

Neither you nor your neighbor have anything on this mason other than name (you think is his name) and his cell phone #??? Um, gonna be hard to sue someone who may not exist. Did you get a vehicle license plate number? Did you confirm his name with any permits or business card or anything???

Well Barnum is right...there is one born every day.
Take as life experience and kick yourself in the rear......then hire a legitimate contractor to do the job.
But don't worry if the job he was doing is right or up to code......I'm sure it is(sarcasm).

'I am afraid no. There is no contract, no signature, even in the case of getting all the "techs" information, will be your word against his.
