my uncle says i'm lazy and i have to pay rent is that legal???

My legal gurdian is my mom but she walked out now no one has custody....

If he is your guardian then no he if financially responsible for you until you turn 18. Is he receiving funding for you in anyway? Say child support from a parent, or government assistance? If he is it seems your uncle is looking to make a buck.

It is a guardians or parents responsibility to support our children until adult age. At the age of 18 then yes he can ask you to pay rent but until then if he is your legal guardian then to bad for him he is responsible for supporting you.

Also keep in mind if he is your legal guardian he also has to make sure you are fed and clothed and have all your basic needs met.

Well, if he is your legal guardian, and not just who you currently live with, then you would need to care for you until you are not a minor. So, generally, he would have to care for you until you were 18, unless he could fight otherwise in court. However, if he was never state appointed as your legal guardian, then he is under no obligation to give you anything, and therefor can make you pay rent. Also, keep in mind when the law says he must care for you, that would mean only to provide food and shelter. If you are expecting for him to pay for other things, this may be his concern. I know someone who was angry because her mother wanted her to pay to live at home, but she also used to give her money all the time to buy expensive makeup, shoes, etc. so it was more to prove a point than anything. But if you are being rational, and he is your guardian, then fight it.

if your uncle is your legal guardian, nothing you own is yours anyway. He could legally take all your paychecks and keep them.

if he is not your legal guardian and you live on his property, the situation might be more complicated, since your legal guardian is responsible for providing housing for you, legally your guardian should pay your rent or other cost of feeding, housing & clothing you. however, your guardian can do that by taking your paycheck.

My guess is that your best bet is to try to help out around the house as much as you can, but i also don't know the details of your situation.

Is he your legal guardian? If so, it may not be legal.
However, your legal guardian probably doesn't have a duty to buy you expensive new clothes, no duty to take you out to restaurants or to see the movies and what not. I suspect if you pull the "law" card, you'll find yourself paying for a lot of things on your own, would cost more than simply finding a job and paying rent.

Besides, jobs look good on your college applications.

buddy, it's ILLEGAL....you are still a minor. no matter what no one says. once you make 18 he can make you get a job or he can put you out. but he can't make u pay at 16. now, your legal guardian is suppose to take care of you up until you make 18. if he's not your legal guardian it's just like living with an older brother or sister...they can't do sh*t!

To legally force you to pay rent, you would need a legal contract to enforce it. Minors cannot sign binding contracts!

If your Uncle is not your legal guardian, he is not legally bound to support you either!

If he is your legal guardian, I believe he is legally obligated to provide you with food and housing until you are no longer a minor, unless you are an emancipated minor or he gets a court order to evict you.

That's it though. He doesn't have to provide you with anything fancy in the way of clothing, food, or anything else.

We use to have to give 1/3 of our earnings to run the household. I think it depends on if everyone has to contribute to make the household a unit that is not in debt.

Depends on your state. In a majority of state's, no, not until you are 18. However, if you have a job then you should contribute, int he long run it will prepare you for life and getting out on your own.l
