My mom walked on me less than a year ago and i live with my dad and grandma but when we went to get my social security card they said that only my mom could get it because no one has custidy of us but her....so since she walked out does that mean i'm automatically emancipated?

Legally, no.

A court has to declare you emancipated (unless you've already turned 18, which I doubt since you're asking this question).

And in this case, given that you live with your dad/grandmother, they'll probably award custody to one of them if you bring it up in court. Which isn't a bad thing.

And sorry about your mom.

No. Depending on which state you are in, you can achieve automatic emancipation by one of the following 3 actions:
* Joining the armed forces
* Getting married
* Reaching the actual age of majority (which is usually eighteen years of age)

Barring those 3 conditions, you may become emancipated by petitioning the court in the state which you reside. Be prepared to provide the following: Proof of ability to independently support yourself financially, including, but not limited to feeding, clothing, and otherwise financially taking care of yourself; Proof of adequate living arangements/housing; demonstrate an ability to make decisions for yourself; demonstrate the maturity equal to that which may be expected of someone of the age of majority; proove that you are either still in school or have already received a diploma.

Again, that all varied from state to state.

Abandonment by the mother is a waiver of her right to the custody of the child. Thus, you are already emanicpated but have to prove it in court.
