I will be filing for divorce at the beginning of the week. How long does it take to get a child support order?

Can I request back child support from the time we were seperated this summer for four months when he was making twice the money that he is now?

**They will be living with me. There is no possible way that a judge will give my husband custody of our children. Without going into too much detail, there is documentation regarding him being an unfit parent.**

**Yes, I DID have something to do with the documentation. So did HIS mom, police reports, the company he worked for and others.**

Most courts will grant temporary child support while the case is pending upon filing of a motion for the support and holding a hearing. Best to get a lawyer for this. Also, in some states you can ask the judge to make it retroactive but many states limit retroactivity until the date of filing the motion or the date of filing the divorce. Once again, a lawyer in your state can answer this question with more certainty.

A child support order will depend on the state that you live in. Generally 3 - 12 months. Your attorney can file a seperate CSO before the divorce that can backdate to the date of seperation. It is good advise to do this. Hope this helps.

infant help and custody are 2 distinctive subjects. the two ought to be court ordered. considering the fact that your father grew to become into court ordered to pay infant help on your mom, that's what he's doing. considering the fact which you mom grew to become into granted custody of you through yet another court order, you carry on together with her. in case you want to stay with your father, and your mom isn't keen to allow you to accomplish that, he could desire to bypass back to court and petition that the unique ruling giving your mom custody be overturned. to be certain that that to succeed, he could ought to teach that living with your mom is a possibility on your life and secure practices. So no, you asserting you do unlike your mom (as all little ones your age do quicker or later) ought to no longer make a choose overrule an present custody order.

I PAY IT AND GOT RAKED OVER THE COALS BUT HERE IS THE TRUTH......YOUR ORDER FOR SUPPORT WILL BE ACTIVE FROM THE DATE YOU FILE THE MOTION FOR A SUPPORT ORDER NOT BEFORE NOR CAN IT BE MADE RETROACTIVE PRIOR TO THE DATE OF FILING THESE FORMS. THIS USUALLY WILL BE RULED ON WHEN YOUR DIVORCE IS FINALIZED AND MATTERS OF CUSTODY ARRANGEMENTS HAVE BEEN ORDERED BY THE THE COURT THEN CHILD SUPPORT AND ALIMONY IS FIGURED. THIS CAN TAKE ANYWHERE FROM 2-9 MO. DEPENDING ON THE STATE STATUTES ON "COOLING OFF" PERIODS RECOMMENDED PRIOR TO THE FINALIZATION OF A DIVORCE

"There is documentation regarding him being an unfit parent.**"

Did you have something to do with this documentation?

I ask this because if you did and he proved otherwise, it could go in his favor.

I work with a guy who's wife made up alot of false allegations and she was caught lying, and lost custody.

Good luck

you cant get child support until the divorce is done and the court has decided who the primary custody parent will be.
