"~Mommie 2 Wyatt" is way off! Don't listen to her.

When fathers fight for custody all the way through court, they win more than 60% of the time. Many men don't fight custody all the way.

However this is not about the father or mother it's should be about the child!

The very best for children 95% of the time is joint custody and as close to 50% physical custody as possible.

Laws in your state may be different, but in Texas the parent who has possession of the child at the time of filing for a divorce is presumed to get primary custody rights. In Texas we no longer give exclusive custody to just one parent (unless there is do cause), we have joint custody. One parent is the Managing Conservator and the other is the Possessory Conservator. The Managing has primary custody and the possessory has like weekends and summers, the possessory pays the managing child support.

You need to discuss these issues with your atty and see what is in the best interest of the child.

Well if you are the man there is really nothing you can do to get full custody unless the mother is really unfit.....

The mother usually gets custody of the child no matter what and the father gets visitation rights...... best a father can hope for..... Get a good lawyer and fight it and maybe you will win if you can prove that she is no good to be around the child....

Good Luck and i hope you get what you want if you are what is in the best interest of the child.
