Crime, yes to those celebrities whose bodies get cut out of real pictures and affixed to their supposed "new" love interests, with quotes that may be attributed to them.
Yes to the common person, who said something out of context about something completely unrelated or in a fit of anger, and this is used to quote him or her as gospel proof of "insensitivity", "weirdness", "craziness", "malicious intent", etc etc
Before using someones word, you have to ask them for their original intent, frame of mind, inflection on the words as they said it.
If this type of verbal dealings fascinate you, you are probably a good reporter or have the makings of a great lawyer.

Depending on the situation and how the words were warped, it would be considered perjury in a court.
If it's done maliciously or to the detriment of the other person, it's not all so nice either.

in certain instances it could be construrd in a criminal context,usually though it is bad reporting and immoral and misleading especially when done with the intention to mislead and show the other person in a bad light.

Doubt it. Newspapers (liberal and conservative) do it all the time to candidates they don't like. So do the candidates themselves when talking, writing, or making speeches about their opposition.
