I need some legal advice about something that happened a few days ago. I am in highschool, and an aquaintence of mine asked if he could listen to my iPod, I have a problem saying no to people so I handed it over. This was in theatre class, and I was called onto stage to do a scene, I turned to him and asked for my iPod back, he said he would give it when I was done. So I went on stage and did my thing. After the scene was over my adreneline was pumping so my mind was elsewhere, he was called onto stage after I was done, and I forgot to ask for my electronic back. The bell rang dismissing the class, I stood up and started to put my backpack and jacket on, then it occured to me that he still had it. I ran out of class looking for him but he was nowhere to be seen. The next day I confronted him and asked for it back, he said he left it on his seat.

Now I don't sit next to him, there's a girl that sits in between us, and the room was dark, not even she said she saw an iPod on his seat, so how could I of possibly known? I know I hold responsibility for lending him my iPod in the first place, but I feel he shoulders most of the responsibility for not telling me where he put it. I even asked the teacher if anyway reported seeing one and he said no. I don't think he stole it, but my dads taking them to court to pay at least 200 dollars for the misplacement of it. So I need legal advice, do you think I have a case? I admit this isn't my first time losing my iPod, before that my friends kept it hidden from me as way to "teach me a lesson" still, will he be held liable for it in court?

I just need to know if I have a case here. So please don't tell me to look in the lost and found, cuz I already did that. And don't tell me to buy a new one, those things are expensive. I'm going into court in about a week, I need to know how things are gonna go.

Yes my bad, it's small claims court, I'm not getting a lawyer I just need to know how things are gonna work out.

try small claims court. may cost you more if seek the advice of a lawyer. if you can afford a lawyer buy a new ipod and consider it a costly lesson. God bless you.

He say he lost it but it may only be that he STOLE IT, if you can't prove it then you are out of luck. I am sorry but the only way to prove that he lost the ipod is to have witnesses say they seen him put it down and left it there. He can eaisly lie and tell the judge that he gave it back to you or even worse say u never gave it to him, especially if his parents have to pay for it and the fingers will point back at you. Other than that I dont think that will work with a judge. Judge will say "you should have had it at school in the first place, you are being careless about your personal possessions." check the office to see if it's been turned in if not really not much else can be done except for asking around and hoping to find an honest person. If that can't be found then buy a new one and go on with life...It's just a toy

Your friend assumed responsibility for your I-pod when he took it from you. If he was careless with it then it became his responsibility to care for the item and return it to you in same condition as when you left.

As a parent - this is why my kids are not allowed to take I-pods and cell phones to school.....they don't come home! Plus, school is for learning not for jamming.

i'm sure you school has rules as to not bring your personal items, expensive items should not be on campus ! unless you take responsibility for your own actions then hey, bring all your money to school and let her rip

this is a civil matter. tell your parents to contact his parents to work out a way for him to repay you for the ipod or get a replacement.

he lost it, its his responsibility to replace it.
