Asking on a friends account W/ Permission......

I as married to this man for 5 days- huge problem arose and we got a divorce as soon as we were back in the states from our honeymoon.... the marriage was never even consimated.

That was roughly a year ago- which sc law requries a year of seperation before divorce is final.
BUT!
back in oct I spent a night together with him (NOTHING SEXUAL HAPPENED) He is now trying to re-up the on year seperation for SPITE because now I have a wonderful boyfriend who I love.
Is this legal? and is it possible he can do this.... what can i do to stop him or end it NOW as the one year is about to end.....
PLEASE HELP.... I dont know what to do.

for a marriage that lasted 5 days you didn't need a divorce an annulment would of been fine get a lawyer

You were not married long enough for any judge to count this as a viable marriage. If he files a petition for another year the judge will deny this. Be cool. What you are saying about spending the night with him is considered hearsay. Did anyone witness your spending the night? It actually does not matter. Your attorney could have and should have filed a long time ago for an anulment to the marriage since it did not even last for one week. Your husband will continue to look for things to drag this out because he is not happy. It will never end unless you take action. What he needs is a girl friend.

I don't live in your state, but there is a US law that says you can have it ANNULLED, due to it not being consummated. Talk to a lawyer about annullment. Don't ask for a divorce. Ask for an annullment.

If you are low on money which 37 million americans are living under poverty, go to your local mediation /free legal help place and someone will look at your income and help you answer your question..just a thought and even do paper work for you, to me it sounds like I would not worry, ..but go speak with someone
