In our State in order to be married by a Pastor, or even a Judge for that matter, you must first recieve license , a blood test,
The list goes on . All of this generates monies which go to the State.
In order to be reconized as married for IRS, Tax purposes etc.

Most states have done away with blood tests as these were for syphyllis!
The government makes money off of people which has nothing to do with income. These are usually sales taxes and fee's, such as the fee you refer to, that has gone up many times in most states.
Your state, or any state, can do away with the money it charges for a license, but don't hold your breath!
Anyone qualified can marry you, even lawyers who are automatically JP's upon graduation from law school and passing the bar! Any payment to them does not represent money paid to the state, but in order for a marriage to be recognized, it has to be done legally! They don't have to charge and most don't, though many are given a "donation"!
I never could rationalize people receiving tax breaks for having children so others with none would have to pay more! No parent, or many anyway, could ever pay the cost of their childs education! It generally requires those without children to pay for schools! I bet even conservatives don't mind that!
Many laws were passed as new rules came about for services or benefits authorized by the government! It also, I think, kept those who were not legally able to be married ftom being married, like cousins and underage children. I also suppose it had a lot to do with child support and other family issues!
I don't have an issue with a license being required as the state does need to know that those being married are elegible in the 1st place! They don't have to charge for it!
They also don't need to do blood tests as that went out in the 1960's and 1970's in many states!
Yes, the states do have the right to control who gets married, much of which is passed down from the feds! If they did not we would have 1st cousins being married, which is legal in some states, brothers and sisters being married, as well as people with multiple wives and underage children. In order for Utah to become a state the practice of polygamy had to stop and is illegal
Is you issue the money or who you can't marry?

It depends whether you simply want a religious ceremony, or the rights that come from the state when you enter into a civil contract.
A state can't bar you from being married by a Pastor, and in the eyes of your church, the marriage would be official. However, since you haven't complied with the state's requirements, you would not get the benefits the state provides.
The state certainly can control who can get married in terms of a civil contract, but that has nothing to do with a religious service. All states should also treat all Americans equally; so the civil union should be open to all, including same-sex couples. Religious services should only be offered to couples that qualify under the rules of that religion.

If you want to get "married" get "married" and have what ever kooky ceremony you want to whom ever or what ever you want. Think about it for a second, there is nothing stopping two gay people from buying each other rings having a ceremony and calling themselves "married" it is just not recognized by the government. If you want all the benefits from the government for actually being married then of course they get to set the rules over how and who gets to marry. Seriously, if there are no rules what's to stop me as a single male from claiming I'm marring my dog so I can get tax benefits. So obviously even you would agree there has to be SOME rules, and since there has to be SOME rules then obviously SOMEONE has to set those rules and that SOMEONE would have to be the government. What you are really saying is that you don't like the rules in place. Which is fine, vote for candidates that support changing those rules but don't say there shouldn't be any or that the state doesn't have the right to set them because that's just plain silly.

Yes, though marriage is a bond of love in people's eyes, you are actually applying for a legal license to be recognized as a legal bond from the state.
