My boyfriend is the father of a 5 month old baby, from a week long tryst that we just found out about. We did not know he was the father until about a month ago. The mother is 20, she has one 5 year old son who she now get child support from his father, and she is 3 months pregnant with twins (yah I know she's a winner). My question is my boyfriend is going to start the trial to get a custody schedule and child support amount. But she is getting married to the father of the twins she is now pregant with. OH BY THE WAY.. she's currently on welfare, that pays for her apartment/townhouse, so if she gets married will that change how much he owes, or because she is on welfare is that irrelevant/ Or will her welfare end when she gets married? My boyfriend makes less than $ 800 a month so he's trying to figure out if its in his best intrest to wait to start the trial.

Your boyfriend must pay child support for the child he created. Period.
Sorry, but a man who has flings with welfare mothers, creates babies he doesn't know about (condom anyone?) and pulls in a whopping $800 a month doesn't seem like much of a "winner" either.
I think you'd be wise to stop questioning his financial obligations and ask yourself why you want to be with someone like him.

He can petition to have the courts look at her financial situation. However, the courts could not make him pay more than half of his income or he would need to prove (which isn't hard) that it would is a finanacial hardship to pay a certain amount. There is not way to get out of child support payments the DA can actually come after you and revoke your liscense your ability to leave the county if you do not pay child support and can create larger hardships.

My recommendation is that when you do answer the motions that you include your housing payments (i.e. your rental agreement), and submit your living expenses. It depends on the county but you generally can download these forms that you need to attach to your answer of the petitioners motion.

If you need help there are free legal clinics (they will not represent you but they provide legal information). Be prepared, it also shows that you are interested in the child's welfare which that is what the court is supppsed to be soley concerned for.

Also, not to piss of the Judge....show the courts that you are an adult, responsible, and mature...don't walk in the court room prideful then the Judge can reject to your requests.

it's irrelevant because the child isn't getting married the mom is. think about it if you were getting married would you want the father of your baby to stop paying and leave it up to some other guy?. but it doesn't change anything. hope i helped.

No child support unlike alimony will have to be paid.
Child is based on the a percentage of his income. It may in fact go up as he makes more money

They will base his payments on what he earns.What she does or who she marries will have nothing to do with it-
