Can you write predated checks? Can you deposit a check before the stated date on the check?

I had a very nasty experience with a lady. She wrote me a predated/postdated check, not asking me to deposit it after the stated date. I deposited it several days later, but before the date on the check. And later on, she called me, accusing me of messing her bank account, because she didn't have enough fund in her bank when the trasaction was done. She even asked me to pay for the fine... Well, I didn't pay her anything...I just want to know if it is against some of law to write predated checks and who should be responsible for the date on the check.

It depends on the bank, if you noticed some banks put on the checks or statements in fine print that they reserve the right to cash a predated check. Call your own bank and ask them what are they going to do if the check is predated. Frankly nowadays, that all checks are cashed electronically, no one may even notice a date on the check and put it through. If the teller at the bank takes the predated check, it may go through the entire system without ever being looked at again by a human being. If you are trying to put a later date on the check, ask the person you give it to not to cash it, but if they chose to cash it sooner it may go through.

Those are "post dated checks" that are written today with some date in the future on them. You can write all the checks that you want with yesterday's date on them.

Unless a person is actually LOOKING at the check you give them. The date means nothing. You give me a check, I can deposit it, regardless of the date.

Your questions imply that you are out of money. Writing dates on checks won't fix that.
