That's a tricky thing to get a judge to appvoe. I think if your ex has any objection to the matter you pretty much don't have any hope of making it happen.

i presume you are in england. i have experience of this, you need your ex's consent to remove the children from the country..otherwise you have to apply to the courts.. where you will need to demonstrate why you want to go and how it will benefit you and the kids..the fact your mums there will hold a lot of weight and if you ensure proper terms of contact with ex partner. they are not guarenteed to allow the kids to go but i think if you follow all the above you have a pretty good case. good luck

you have a pair of subjects here and it incredibly is only too undesirable you waited to handle a pair of them. you will possibly be able to desire to get your son's start certificates fixed and have you ever listed because of the fact the daddy, What you will possibly be able to desire to do varies with the aid of community so verify on the clerk's place of work the place you reside. this may well be much less annoying to end until now you have filed for a divorce. then you definately might desire to get your son a US passport and a British passport with your nevertheless spouse. you will possibly desire to get an legal expert/legal experts who not basically handle kin regulation yet comprehend something approximately immigration and shifting in a foreign places u . s . with a minor, even however your spouse has agreed to this. you will possibly desire to talk the recommendations with him/her, it would desire to be greater beneficial in case you come back to the united kingdom with him until now submitting for the divorce. If she might supply you a notarized letter asserting that she supplies her permission so you might circulate to the united kingdom with your son for an indefinite time or to stay completely there is not any reason you may not leave without needing any custody or divorce courtroom interference. dad and mom (legal, so get that start certificates carried out) are allowed to circulate in a foreign places u . s . to stay without different permission than that of the different discern if there is not any courtroom in contact already. good success to you and your spouse and particularly your son.

This is something you should discuss with your ex and your solicitor. It would be much easier if all parties agree. If not, the court would have to approve that the children could be removed from the jurisdication or you could be held up for kidnapping

My kids live with their father, and he cannot take them out of the country without my permission, unless he applies through the courts, which I would still object to, and wins.

There is an answer that says that you need consent but if you and the children have the passports no one will ever stop you.
