Hi there...my husband is stationed away from me. He has threatened divorce and froze all our joint accounts with USAA. USAA said they will not help. Can or will the JAG lawyers help the "wife". I am 3 hours away from a base. Military One Source gave me the runaround. I'm at my witts end. With him yanking the funds...rent was not paid. What can I do? My children and I are now 120% desolute and state agencies will not help until a divorce is final.

You need to contact his command. Explain that you're the spouse of this staff sergeant, and that he is failing to support his dependents (you and the kids). Spell out what's going on.

You'll want to talk to his sergeant major. Get a number to fax the letter to.

The Army has a table that governs adequate support of dependents. If he's cutting you off without a cent, he's falling short.

Understand, they can't order him to pay. They can just take action against him for failing to support his dependents.

JAG lawyers would probably help, but you'll have a hard time driving 3 hours each way just to sit down with one. Contacting his command should get good results.

P.S. Supersoldier, separate rations aren't for the dependents. They're for the member. I agree dependent rate BAH is intended for dependent support, however.

This sounds very strange. The military normally is very conscientious about the financial well being of the spouse and especially the children. Unless there is a really ugly motivator behind his divorce threat, one that he has proof of, it makes no sense that JAG not helping you. You should also seek to speak with his commander.

As a dependant your husband is obligated to support you. he gets BAH and Separate Rations which is not for him it is for the dependants. Namely you and his children. Call JAG have the notify his command that he is not providing support for his dependants. he can get in serious trouble for this. Look out for yourself. if one person doesn't do the job then talk to someone else. There are regulations in the military that state he must support you as long as he is married to you and even after the divorce he is obligated to send money for his children as long as he is on active duty. If Jag doesn't help call a congressman. Just tell the congressman he is taking money for dependants and not supporting them. Bottom line you can't get money for dependants if they get no support. More them likely you will have to open a separate account and he will have to send you money by allotment. If you have anymore questions send me a email.

JAG will help family members since you are STILL offically the spouse.
