Yes, the victim is overpowered by fear or physical means. Asking the attacker to do something to lessen the chances of fatal disease or other health issues is not a mitigating circumstance.
We have even investigated cases where the victim tried to help an attacker who had trouble performing as they were very frightened and feared being hurt worse if the person didn't get what they want.
As for the smart asses saying no, they asked for it... get a life, maybe someday you'll be on the receiving a good old prison rape yourself!

Rape is sexual intercourse without the consent of the individual.
So once a woman says no, regardless of whether she asks her attacker to put on a condom, and is actually lucky enough to have him do so, it is still rape.

Sorry, but just because she was wise enough to ask him toput on a condom does NOT imply consent. Would asking a killer to shoot you in the chest instead of your face so it doesn't mess your body of for viewing imply that it is okay to kill you? No. Does giving up your money to an armed robber mean that you have consented to his request and given your permission to take your money? NO.
Also, it doesn't mean she is not fighting hard enough. A gun to the head or knife to the throat does not leave much opportunity to fight back. She is doing what she must for survival, and if that means using her instincts to lessen the possible long term effects by asking for a condom then more power to her, but it DOES NOT imply consent that she wants it. It is rape, plain and simple.

Any act of forced sex is rape. To ask the attacker to use condom is a precaution to lessen the consequences for both the persons.

Rape is rape, it doesnt matter if you ask him to put on a condom. Its bad enough your being violated. At least your not risking a diease on top of it.
But Of course that doesnt mean he will, after all your being raped and he probably don't care. :(
If he does use a condom you can get his DNA
So keep that in mind.

You must what is rape first.Rape is defined as forced sexual intercourse; force may involve psychological coercion (being "talked into it") as well as physical violence. This includes situations where the victim may be drunk, drugged, asleep, unconscious, or for any reason unable to say yes or no. It doesn't matter if a girl dresses sexy or a guy is really "bombed," sex without proper consent is RAPE. Period.

No Actually rape is termed as - Any Sexual activity without the consent of the woman, Even if the woman is a sex worker And if the woman asks her attaker to put on a condom means she has her consent.

I think it is still rape. If you want him to do that it is not rape. But if he is doing that with out your consent that is totally RAPE!! Most men out there wouldn't listen even if you begged him to put on a condom.
