It really depends on what the labor laws in your state state about firing. Some states are what is called "at will employment" states, which means that your employment at an organization is of your own free will, voluntary, and you can be removed for any reason, or for no reason at all.

However, if you feel that your termination was based off of discrimination or harrasment (based on your race, religion, sex, nationality, age, disability, sexual orientation) these ARE protected by the law and your termination was unjust and you should search legal counsul and advice.

Go to the department of labor website for your state and look at labor laws. There should be a section of bylaws for termination. Good luck.

they have probably done something, some where to make it legitimate. they always do.

if you have been there less than 3 months then they can let you go for any reason without notice. 3 months to a year you get a week's notice. Rather than notice they can pay you in lieu or notice. The last week you work (or get severance pay for) must be equal to the average hours worked over the last 8 regular work weeks.

search "labour laws (your state or province)" that is all i did. you can search on the page for what you need. It took me a bunch of weeding around the Related articles and such. But I got what i needed eventually.

You count your blessings and move on. He will get his eventually and most likely there is nothing you could do about the situation that would make it any better. At least that is the case in an at will state like North Carolina. If it is different where you live then go to his superior. The problem lies here. If he is such a nasty person then he will be even worse if you get to stay and will make your life even more unbearable.

Call your local bar association for referrals for an attorney near you who specializes in employment/labor law. Then go to see him/her to see if you have a case against your former employer.
