hi! i'm just new here in the states.. like it's still 5 months.. i'm a permanent resident here..

i have a question.. my parents plan that i will continue my studies this coming june in the philippines... my question is... i'm still not 1 year resident here in the states.. is it ok to go there? can i still go back here in the states? pls do help me... thanx.

Yes you can. If you already have the actual "green card" in your possession, you may travel back to the Philippines anytime BUT ONLY IN SHORT INCREMENTS--such as for a vacation. Going back to study a semester (5+ months), presumably for two semesters a year is right on the cusp of attracting the wrong kind of attention from the US Immigration people. Remember, as a green card holder, you are expected and assumed to eventually be naturalized within a short time period. If you show any signs of not taking this responsibility seriously (such as spending too much time outside the US), immigration may at its discretion, begin proceedings to remove your immigrant status. The INS/USCIS laws and policies in this matter are long and complex and it is very easy to misinterpet--so be very careful that you do not trigger any unwanted attention from them with your plans to continue studying in the Philippines.

If you have a green card you can go in and outside the United States as long as you have a passport that is valid for at least one year. The safest place for you to ask this question is the INS they have a 1 800 number where you can call directly and talk to a person, also they are now online and you can search any questions you may have regarding your situation.

i think that in general a permanent resident cannot be outside the US for more than 365 days, unless you secure some sort of permit (not the advance parole). i'm a green card holder myself, and i think that's what my lawyer told me years ago. i wish i could remember the details, but hope that helped a bit anyway.

also, you might want to dig around uscis.gov -- calling them can be quite a challenge.

I don't know the answer but why don't you check with the appropriate authorities in the States it only takes a phone call or a letter, and you will get accurate information.

you can stay in the philippines long enough til you graduate as long as you're a student. i think you need to go to the embassy and ask for a permit for us resident students studying abroad. then they will give you the requirements for you to submit and be granted a long stay there temporarily.
