I know in the State of NV its every three years that you can ask for a modificataion_

There isnt a limt, at least til the child turns eighteen. However you can contest child support if you can prove that the support is actually being used as alimony. In other words if you can prove that the child support is actually paying rent, then you have a case. Next time that you go to court, go prepared. Lawyer up and get the persons IRS returns. This is solid proof that the person is living on child support. This is a form of neglect and the judge will change the custody, and may even order that these excess monies be restituted or face jail time. IN TEXAS!

I believe Fed guidelines are a that states must offer the parties the opportunity to modify support every three years--unless your court order states otherwise (ie--unmodifiable thru emancipation). WI automatically sends a 'right to review' support notice every three years--however, if there is a substantial change in circumstances (you got a raise) the ex can ask for a review. Some states also have an automatic cost of living adjustment added every year in addition to the review process. most states - every year.... if your income goes up she gets more support..... good reason to be very nice during the year and always agree to split extra stuff or just buy it and don't even split the cost....

I always took the approach that if I was still living with her and the kids I would be buying the extra stuff not normally bought with child support... hey, it kept my ex on friendly terms since she knew I wouldn't say no to stuff the kids needed....

Tennis shoes for basketball - 50 bucks
Cheerleader outfit - 75 bucks
having your support go up 200 per month - 2400 bucks
Not having your ex ever take you back to court - priceless

In SC its every 3 years till the child is 18 years old.
Girl I worked with her hubby's x did that to him cuz she had a great job he ended up getting custody of the child.

yes she can, if there are any changes in income (hers or yours) or its been a couple (to a few) years. she can file for review anytime she feels there are changes.

all states are different; in NJ its every two years for a cost of living increase.
