Not legally. However to listen into cell phone all you need is a regular $60 radio scanner from Radio Shack. Anyone can do this so be careful what you say over a cell phone: credit card numbers, private info, money info of any kind. Anyone including crooks could hear it.

Yes, your cell phone can be tapped. Is it legal? If the person or agency doing the tapping has a warrant, yes. Is it admissible in court? It might be, if what was overheard implicates you in a criminal activity. A lawyer (or private investigator) does not have the authority to do wiretapping. This is done by the government and/or law enforcement.

They have that capability, but it's not as if there's some guy in a uniform hiding in a building late at night on an army post 200 miles away listening to your conversation to your grandma. The military has better things to do than to waste resources on things like that, especially right now; the percentage of equipment that even has that capability is few and far between, is widely dispersed and isn't wasted on such frivolity. To think that every conversation every day is being listened to is simply paranoid, conspiracy-theory/tin-hat nonsense. Current agencies who devote the time and the money and the manpower to civilian phone conversations are civilian agencies themselves; and odds are you'll likely go through your whole life without having one phone conversation listened to by a CIVILIAN big-brother agency.

I'll give you some insite on cell phones. I pick them up on my police scanner all the time.
So be careful what you say.
As far as tapping a cell phone. If it can be done, it can't be done without a court order.
If they want to tap your home phone, they get a court order and tap it. You are not notified.

Not without a warrant. That is, if they want to use it in a court of law against you - or anything deriving from the stuff they got from the tap.
Now if they have a police scanner and hear you and your conversation, that is another story. They can listen in and use whatever they like - for anyone can do the same thing - the airwaves is public domain.

Anyone can tap you phone hun and they can do it without permission.
Is it legal? No...it can't be submitted into evidence in a court of law without your knowledge.

I would think that it would not be the lawer (or lawyer) who would do the tapping.
either way, they need a court order.
It would not be a tap if they had your permission.

Legally, only a judge can grant a wiretap, however, others can do it and just use what you say to get more info. They cannot use recordings or statements in court. If they do it, it's a felony in most places.
