Get to the doctor for treatment. An Osteopathic Doctor or Chiropractor can help neck pain. With treatment you may very well start to feel better. The insurance company may even have to pay for your treatment after you settle.
Then get a lawyer if you don't already have one. The time it takes to settle can be fast if you are stupid, but with patience's the dollar amount will be more. The lawyer will get 1/3 the medical bills will take 1/3, the miscellaneous costs will take about 8% and you will get the rest (about 25%) for pain and suffering.
Look up and buy this book "Auto Accident Personal Injury Insurance Claim" by Dan Baldyga. He is a retired insurance adjuster.
Expect this to take several years to settle. You need to know what long term injuries you have, (it could be the rest of your life) and if you need surgery someday you will want that covered as well. Your lawyer will help you with this information. Write down all of your questions and get them answered by the lawyer. (He wont be able to give you a settlement amount, nor can he give you any money up front.)

When you sew for pain and suffering, the amount you receive is usually 3 times the medical bills, so keep going to the Dr. It could take a couple of years to settle, so don't hold your breath.

This is pretty outrageous. When you sign a settlement agreement there should be a provision in there for a payment timeframe, and if that timeframe is not met, the Released Party is in breach of the settlement agreement. I don't know how much money is involved. If it is significant, you can make a claim for interest. No, this is not normal, and your lawyers should know better. Bring up interest fees on the money owed to you, perhaps that will get their attention. Good luck. As for your lawyers "keeping" your money for themselves, that's not gonna happen. They would be disbarred for misappropriating settlement funds from their Attorney-Client Trust Account, and they're not going to risk their careers and maybe jail time for a settlement check.

Like another guy said, don't stop going to your doctor's. If you are hurting you need to seek help.
As fair as your case goes, this could be a year or more. I honestly hope that you weren't one of those people that just stepped out in front of traffic. Then again there's people who don't walk in the crosswalks and get killed because they cross in front of traffice and they're families walk away with millions. Good luck and get better soon.

It may depend on how long the legal proceedings of the case will take.
Also it may also depend on how long you take to reach an agreement for the settlement. This may be between your lawyer and the defendant's lawyer.
Make sure you are in agreement to what your lawyers advises and keep in constant communication with him or her about everything. Ask questions if you do not understand. And don't sign anything you may second guess.....

good previous answers, I had a 30,000 fire claim. They sent me a check for 1800. They do this so if you're desparate, you'll take the money quick. I had to file a legal claim, they then offered me 5000.
My attorney said if they offer 5, then they'll pay 7.5. So I countered at 29,500. The insurance lawyer said I didn't understand. well, long/short...15k.
Time wise: about 4 times longer than your worst nightmare.
