at a cook for spitting in someones food. Will this come up if I file for unemployment.

It might...but apply anway. If possible, try not to tell unemployment that the reason for being fired was your spitting in the food. Perhaps you could say that your boss and you didn't get along and that, that is why you were fired.

In my state both the employee and the employer are interviewed. Each state has different rules. If you work for a big company it may be an HR person talking to unemployment and your HR person may not know the entire story or maybe your boss or HR will never call unemployment back and you will end up getting the benefits by default.

My understanding is that unemployment insurance is only for people who were fired for not fault of their own. Your situation does not fit the definition.

The worst thing that can happen is that you won't get any money. It rarely hurts to ask.

Well, I am hoping you had a good reason for spitting in the food. I know I had fantasies about doing that when I worked at the last restaurant I was at.

Depends on which province you are in I guess.

Since you were fired on the spot, did you get severance? If not go to the Labour Board and fight for that as well. If the reason for your dismissal comes up with the EI officer, just say there was a personality conflict. At that point, unless you admit to it, it becomes your word against thiers.

You were fired "for cause" then and that can go either way when you file for unemployment. There was someone fired for misusing the company credit card where I used to work and they were awarded unemployment. However, it might also be a case where when the employer fired them they agreed to pay it to get them out of there, I don't know.
