The judicial branch of government is charged with interpreting the law, each branch of government has a seperate, but equal job, this is the heart of the 'checks and balances' system where one branch of government keeps the others from acquiring too much power. In the present case, the executive branch seeks to attack the judicial and thereby reduce their power or influence. The framers of the constitution would not be pleased.

It isn't a judges job to make new laws or to modify them. His job is to uphold the law and make decisions based only on what the law dictates. Any judge who changes a law as written should be removed from the bench. Give some of these egotists a little power and they immediately feel that they are above the constitution and the law.

Law-making is the responsibility of the Legislative branch of government, i.e. the Congress. Judges are part of the Judicial branch, and are given the responsibility of upholding and applying the law. If they want to make law, they must quit being judges and run for Congress.

This question's premise is misguided. Lots of poorly educated people think that because judges do things they don't agree with that they are "rewriting the law". Usually they are just performing their constitutional duty.

We just have too many crazy lawmakers who want to write laws that violate the consitituion, like restrictions on free speech such as video games, etc.... or equal protection like saying who can and can't get married, etc... and the courts have to strike these down.

Judge A decides one thing should be the law..

Judge B decides another thing should be..

Because it's a limit of power, making a new law is the legislature power. When the balance of power is in perspective then democracy is secured, http://www.voteprimous.com
