I have a design that incorporates the name of it in stylized lettering underneath it... Would I be able to copyright this in a whole.. or would I have to take out the title... This isnt a trademark or anything.. but It looks good with its name underneat it, and I searched the Copyright website and its vague. It also states that any lettering or words or phrases are not copyrightable.. what should I do?

Oh yeah, The site states that lettering or words are not copyrightable.. however, on the registration form VA it has a section of nature of authorship it has a text option for text with a graphic.. i'm stumped.

To protect the design itself, you could file the VA form. However, if you're using this design and/or the name in connection with products and/or services, this is definitely a trademark issue and NOT a copyright issue.

The application is fairly simple & the cost is $45 per application.

Despite what others state, a "poor man's" copyright is NOT the same as registering it. Here's what the US Copyright Office has to say:

"The practice of sending a copy of your own work to yourself is sometimes called a 'poor man’s copyright.' There is no provision in the copyright law regarding any such type of protection, and it is not a substitute for registration."

send the idea registered mail to yourself (poor mans patent) do not open it when you receive it the seal will be opened by a judge in court.

The copyright has different categories for copywriting, if you have a question you should call and speak with a customer service rep. be sure to be prepared to be on hold for an hour before someone actually talks to you. Have a list of questions prepared for him/her. But if it's important to you it is worth the wait, put it on speaker phone and do some yahoo Q&A. You can not copyright a sentance of words, but you can copyright a sentance of words that are designed from you in a way that it is a specific design. Copyrights are mainly for written works of art like novels and screen plays or trademarks or designs that are artistic like photographs, paintings etc.Good Luck.

Any design can be copyrighted. Just register your work in the Copyright Office so that your work will be determined if it is qualified.

trademark it, register, copyright, all same thing more or less....protects your items.

trademark it. see a trademark, copyright, registered, pattent attorney for help. figure $400-$1400.

do not attempt to do this process yourself, it will take you years, more money and you will miss things. leave this imporant tasks to the experts
