Try washing it. I recommend you take a bath with your DS, making sure you get it really wet and lots of soap on it. Scrub the lower screen really hard to get the dirt off. This is important!!

When youre done, take your moms hair dryer and get it really close and make sure your DS gets really hot. I mean really HOT! That way there wont be any water left over.

Now this last part is important, turn the power on while the machine is plugged in to the ac adaptor. But while holding the power button in the ON position touch the lower screen with your stylus really hard. And by hard I mean, lean on it, put all your weight on it. Hold it for 10 seconds.

That should make it all better.

Don't worry. That happened to me too. All you have to do is either call Nintendo or take the DS back to the store where you got it from. They'll probably let you exchange it.

Maybe it is because the touch screen is dirty you should clean it and then if it still doesn't work return it.
Instructions on how to clean it are in the instruction booklet that comes with your ds.
