I just wanted to know. I work full time ... an 8 hour day. I wanted to know when I am officially supposed to take my lunch. I get here at 9 am and am off at 6pm. Sometimes I don't get to take my lunch till 2:30 or 3pm. That doesn't seem right ... does it?

My boss says go whenever ... but then when I am ready to go ... nobody is here or nobody can cover my position. So what's the deal?

Any ideas or suggestions would be great. Thanks.

Well it depends on where you live but in California the law is you have to take a break of at least 30 minutes if you work 8 hrs and you have to take it no later then 5 hours into your shift. The way it is supposed to go is you work two hours take a 10 or 15 minute break,then work another two hours and then take a lunch. After lunch work two more hours then take your last 10 or 15 minute break then work your last two hours. Hope this helps.

Bro... No kids? GET OUT! I'm not a big advocate of divorce and I know there are too many people who cry "Divorce!" at every question on this board. But your wife is clearly neurotic. Now, you're EXPECTING her to be rational. But she is nuts. She is IRRATIONAL. And you can't negotiate with IRRATIONAL. And men EARN AND COMMAND respect. But you're not capable (or haven't been capable) of earning or commanding respect from your wife. You've been a big drooling vagina. And women don't need a second one of those (have you ever seen one with two vaginas? They don't exist). So bro, here is what you do: 1. Drop this woman. I'm sorry, but you'll never gain her respect. You've already lost it completely, and she's a pyscho in any event. Again, I'm not a big divorce advocate, but this marriage is totaled. 2. Start acting like a MAN. Get your body back into shape. Show some freaking aggression. Show some leadership. I'm not saying you have to be a jerk, but you can't be a doormat. You have to learn how to be generous without being a push over. And sometimes...that means firmly telling your wife that she ain't gonna have her way today. The husband is getting his now. So, get a lawyer, an apartment, and a job. From my understanding, there is no set rule as to WHEN a meal break must happen.

It must happen however........regardless if you paid hourly or salaried ( exempt or non exempt from overtime).

For my hourly staff and salaried staff, there is an UNPAID 30 minute meal break as mandated by labor law. There are also 2 fifteen minute work breaks (paid) that are 1) dependent on being operationally feasible meaning they are not guaranteed and 2) May not both be combined with the unpaid meal break.

If I ask my hourly staff to attend a meeting/class during the meal break, I have to pay them even if they are eating while I am talking to them. My salaried staff ( includes me) don't get paid...we eat and meet and suck it up :).



I am not sure if you are hourly or salaried. Regardless, I would get your boss to set a meal break time for you so that coverage can be set up. Only she/he can do that. Otherwise, you will continue to have this issue. I have done this with my hourly staff to ensure our front desk is covered and people get to eat in a timely manner.

Addendum: You are supposed to have a break after 5 hours.......sorry.I forgot that.

That's the way it is. Your employer is telling you that you can take your lunch when you like, very generous. You just need to work out with your back-up that you'd like lunch at a certain time and could they arrange to be available. If not, go when you can and make sure you have some crackers or something in your drawer that you can munch if it gets later and you're hungry.

Who covers when you go on vacation? Or are sick? You are entitled to lunch at a time convenient to you. Talk to your boss, explain the situation and let him know that if s/he doesn't provide someone to "cover", that you will put up a "Gone to Lunch" sign, secure your area, and leave. Although you are willing to "overlap"- wait for another employee to return from, or delay their lunch to cover your area.

there is no specific time you have to go, but it is required by law to give you a break...I think (not 100% sure) that for 8 hours you get a half hour break, but anything more, you get an hour.

You obviously need to work this out with your co-workers.

You need to ask them when they will be available to cover your position so you can go to lunch.
