how would I trademark my own phrase?

If a phrase is "trademarked" (which is different from "registered" -- see below), it will likely have a TM after the last word.

"Trademarked" is not the same as "Registered" which is designated by ® in almost every case.

You have no way of knowing is someone considers their phrase to be their "trademark" (TM), since registration with the US Patent and Trademark Office is not required.

You can find out if a phrase is Registered ® by going to the Trademark Office web site: www.uspto.gov.

The primary difference between a "trademark" phrase (not registered) and one that is ® Registered, is that if you infringe on a "trademarked" phrase, there can be no monetary damages assessed, but if you infringe on a ® Registered phrase, you can have a court judgment to pay money to the rightful owner of the phrase.

if it was inprinted on something or someware and had a lowercase c with a curcle around it or a small TM on the edge of the phraze or just plain said copyrighted with a year date stamp next to it

to trade mark your own farase you have to go to a lawyer to get papers drafted or the fcc
