Say Hola to jail time.

It's not only theft of checks, but fraud. Could be other charges - identity theft, etc.

So far everyone has answered based on the law and they are correct in what they say. However, (there is always a however), IF charges have not yet been filed, AND the thief were to go to the person wronged and offer to settle everything including NSF fees, if any, etc, THEN MAYBE it would end there. Otherwise refer to all the other answers posted.

You're in a WORLD o' hurt! If you're lucky, you'll get probation--but you definitely could be looking at jail time. They come down harder on this than on rape! Doesn't make sense, but he who has the gold makes the rules.

Fraud is usually a felony. Punishments vary from state to state. You could be fined, jailed or both.
