Sorry to say but this is not discrimination. Unfortunately alot of jobs do unfair things to people and do not follow the same rules accross the board. But that is all it is.....its not fair. But if they sent this to you in email... then they are probably using that as a warning and if they see you doing it again might give them reason to let you go.

If the policy is not being applied to everyone, then it is discrimination however you would have a huge fight on your hands to prove it and you may lose your job if you pursue it. The next time you see/smell someone else in your office eating at their desk, fire off a quick email to your manager to let them know and request that the policy be enforced. Continue to do this and eventually, nobody will be eating at their desk or your manager will change the policy. Of course, you may not be very popular at work if you do this.

Some workplaces don't allow food or drinks at the desk. However, if it only applies to one person or certaiin people where you work, I would ask the boss or someone higher up about. Union or not, it sounds like discrimination. Your height,weight,figure isn't your fault. I have epilepsy and scoliosis, is that my fault? NO! Nor is being nearsighted. If your boss tries to fire you, tell him/her that there are discrimination laws & you will sue him/her. I can see no smoking,drinking (beer,ect.). You can't be fired because someone doesn't like you. That's not a (good) excuse. If it were a good excuse,almost everyone would be out of a job. Just about anywhere you work, there's going to be at least 1 or 2 that may not like you, some people are just that way.

As the questioner explain the problem the answer is "YES". The correct responce is to put the request in writing - (both the company policy & the deman that you are not permitted) - follow the rules. STOP eating at your desk. File a formal complaint of discrimination charging the person who made the decree.

Stop worrying about everyone else, it is your job on the line. If company policy is don't eat at your desk, than don't eat at your desk. It's called growing up and being responsible for your own actions.
Anyway, if the current supervisor doesn't like you, it would be stupid of you to give her any reason to get rid of you, and by knowingly violating company policy that is exactly what you are doing.

Lets see you can have several kinds of discrimination by law: "Currently, federal law provides basic legal protection against employment discrimination on the basis of race, gender, religion, national origin or disability, but not sexual orientation or gender identity and gender expression." It's not technically discrimination to let you not eat at your desk. It might not be fair to you but I don't think its legally discrimination.

Your Manager likely doesn't like you because of your very poor grammar and spelling...also, you were likely pointed out because your food smells more than the others around you. Many offices have this policy and it is a good thing...go eat in your car.

Sit down with your boss about it. They cannot pick you you if you aren't the only one doing it. Your boss should have sent a mass email asking everyone to start following the policy.
I believe that if you bring up (as an example) that someone is doing their nails during work hours and they aren't disiplined for it, you can start doing it as long as you confronted your boss about it.

I'm not sure if it is but it is not fair, it could maybe be discrimination and u need to point that to ur boss that everyone else does it and they should get punished as well.

Maybe, but if that is the rule, even though others are doing it, I don't think there is much to do about it. Because that would be someone's response is that that's the rule.
