I would not waste more money on a lawyer. I am sorry but you have a bill that you have to paid regardless of what the W2 form indicates. Yes, you should ensure that a new corrected W4 is done at your place of work. You have until April 15, 2008 to pay the tax bill. Get your state refund back and use it for your federal if you can. Make payment arrangements with the IRS.

It willl depend on how many exemptions you claimed on the W-4 you had on file. On the first of every year you are supposed to file a new one and you should have put down Single with zero or one. Anyway, if you had a W-4 in force that had you as married and claiming zero you should not be in too bad of shape.

I'm married, but file at the higher single rate so that I get money back. So in your case you are most likely going to owe.

The single withholding rate is higher than the married withholding. You might end up owing more if you do not have children or some other deductions.

You are supposed to file as your current marital status as of 31 DEC. If you left your taxes when you were married as "Single or Married w/ single deduct." then you should be fine but if you filed last year as married when you were single... Ick... Would hate to be you. Can we say, audit?

There are other factors to consider when taxes are filed, but the main ones would be filing status and # of dependents.

I don't think it will matter. What will matter is if you made more money in 06 than 05. Not an accountant just taking a good guess.
