i have recently started having problems with my neighbour, both my and his house has 2 cars and we have a shared drive. Me and my partner are forced to park on the road as my neighbour has parked one of his cars, the one that isnt used often, on the drive and is blocking access to our garage and so when i put my car on the drive, usually when there is no room on the road, he then blocks my car on the drive and i cannot get out, which is a huge inconvienience as i leave early in the morning. I need to know what i can do to get him to move this car as not only can we not use the garage, the car is parked by the back door and causing an obstruction. When approached he says he has every right to park the car there but if this is the case then surely so do we. Please help.

Is there a homeowners association?
It sounds like you are living in a townhome community of sorts. If so, there have to bylaws for who can park where. I'd investigate and then speak to the proper authorities (homeowners assoc, landlords, police, whoever).
Or, you can always park on the road and block his car into the driveway. Maybe take a day off of work?

I would try reasoning w/ him that u both have 2 cars, so each of u should get to park one of yours on your respective side of the 2 car drive and the other on the street. Then try also explaining that blocking the door is a fire hazard and blocking a driveway is illegal and his car can be towed and impounded for it. It sounds like u r a very nice person who tries not to be confrontational, but if this inconsiderate person continues to take advantage of u, I would suggest filing a complaint w/ the police dept. or taking it up w/ city zoning (I'm sure there r records indicating where the property line of the your driveway starts, which he has to respect) Just be sure to continue not to lose your temper about it so that if u have to cross his property line to ask him to move again he doesn't try to turn it in to trespassing (which any normal cop will side w/ u about when they see his car blocking yours in the drive as long as u haven't caused a disturbance)

If you are in the UK, you first need to look at the title to your property (you should have a copy of it with the documents that came from your solicitor when you bpought the property. The title has information on your rights and the rights of your neighbours. this is a good starting point. If your title says that the drive has to be kept unobstructed then you start by writing a polite letter to your neighbour detailing the rights set out in the deeds. If that doesn't work, you need a solicitor to write to your neighbour. If you have a right of way over the drive then your neighbour cannot cause any obstruction to your right unless the right of way is drafted to enable him to do so (rare).

Since this inconsiderate neighbor is not only blocking your garage but blocking your back door , you have the right to notify the police department. You have the legal right to have full entry in to your home . Doorways should never be obstructed as that is a health code violation.
I would definately call the police department first as they will take care of this matter. This neighbor needs to know that what he is doing is totally inconsiderate and unsafe as well. Good Luck!

as a local council legal administrator you have the right to seek free legal advice and obtain a copy of the property deeds. these papers will inform you with what rights you have. you may have a case of whats called collective rights, which doesn't change much its just a legal name for sharing. or you may have the right to give the local druggies a shout, and obviously a few quid and ask them to hot wire the motors concerned, drive them to a secluded spot and torch em. the money you give them is so that they can get a taxi back and kick ten tonnes of crap out of him thus hindering any further chance of driving a car. hope i helped......../

I am having the same dispute with my neighbor.And I brought it to the managers attention and he told me to confront him and tell him he has to make room for my vehicle just as we do him.Blocking entrances to house though that is illegal whether he likes it or not.Because if there was an emergency and the police or fire department has to get in that way he is at fault for anything that happens because they can not get into the dwelling.I would make it clear to him that he can not be blocking an entrance to the dwelling and speak to your landlord or management.

If it`s a shared drive he has no right to cause an obstruction or deny you access to your garage. If I were you I`d see a soliciter. It will be worth the cost.

a solicitor is the answer and if he is obstinate your solicitor can get notice served on him you will win in the end i assure you so go ahead and get to your solicitor pronto//inform him what you intend to do
