I have been recently divorced. Married 6 years. I was a stay at home mother with two very young children. My husband was cheating. We decided setle out of court, stupid of me. Well, my husband made over 100,000 last year and pays me 750.00 a month. (Georgia). The lawyer I had were I got the divorced and recenlty moved from would not return my phone calls. I still have no permanent job and my parents help me with bills. My ex-husband just remarrried 3 months after our divorce to his rich mistress. Do I have good reason and proof to modify him?

so sad....im sorry. Maybe he wasnt such a good husband, but is he at least a good father? If he is maybe you can have a private converstion (when he isnt around his new wife) with him and explain that you need more money for the kids. I think that would be your first step. Good Luck

It depends. Some states are pretty backwards. You probably can qualify for Legal Aid, which is free attorney if your income is low enough. Your child support is WAAAAAAAAAAAY below Georgia's guidelines for child support based on his income. A lot depends on the out of court settlement agreement you entered into. You need to get an attorney ... check Legal Aid by calling your local bar association.

Get a new lawyer and discuss modification with him. I dont think your ex's new wifes money will play a role in child support though, only HIS income. But it doesnt hurt to go ask a lawyer where you stand. Also. im very sorry for all you are having to go thru- men can be such bastards. Good luck to you!

It all depends on how legal the out of court settlement is and the language within it. If nothing is written in there in regards to increases due to income, cost of living, etc., you could be screwed. I would suggest finding a new lawyer and exploring the options available though.

You dont need reason or proof to bring about a modification. File the papers and get proof of your monthly bills. Good luck!
