I was just reading some yahoo answers and this question came to mind. Lets say a male met this female and she was going to have a sex change to a male but they got married first before the surgery. Once they're a male is that marriage they had considered legal or void? And no I am not a transgender this just interested me and got me to thinking because I don't know.

In Michigan the answer is "no."
Reason being: Even after a sex reassignment the gender on the birth certificate is unchanged, and that is what the courts go by. This also means that two women (or two men) can not get married if one does get a sex reassignment.

Two friends of mine are in this position. One an MtF transsexual, and another, an FtM transsexual. Both were in separate male/female marriages prior to transitioning. The former is still together. Only 5% of the marriages (i.e. that they stay together,not if the govt say's their married) survive a partner transitioning, about 1 to 2% are actually still sexually together.

The legal issues are not clear and are specific to whichever state they happen to be in.

Some states have no clear definition of gender. Others have no specific provisions in the stupid gay marriage laws for this.

Yes their marriage would be voided. I lived in New Mexico and I knew a man who had a sex change and was married. After it happened their marriage was voided because it's against the law in NM to be married to a person of the same sex.

There aren't really any laws on the subject, so as long as no one saws something, the marriage would still exist. I met one transwoman that won't change her legal documents to say female just in case a law to invalidate those marriages passes.
