Can my band use it without getting sued?








p.s. The lyrics are pretty much exactly the same too

To answer that question, I would have to read your lyrics. Songs with the same title are okay, but the lyrics can be iffy. either alter them without changing the meanig or just don't use them at all.

p.s. my band had the same problem with a part in one of my lyrics. e-mail me your own American Idoit lryics!

Do you know the unlikely chance that you guys came up with the exact same lyrics and song independently? I don't believe it.
You have NO case unless you have proof that you wrote the song first...which I doubt.

You can probably do the song live (You're supposed to get permission but if it's a small venue you can probably get away with it) but I wouldn't try putting it on a demo.

Also try being honest in the future.

if you did not copywrite the song before green day did you may be in trouble unless you have proof that you performed the song before green day copywrited it.

note...you can have the same title for the song as long as the lyrics and music are not close enough that the song can be understood to be the same..

(For example Pink Floyd wrote song Wish You Were Here that sounds VERY different from the Incubus song Wish You Were Here, so there wasn't a copywrite problem.)

Yes, many bands have songs of the same titles, it's perfectly legal.

The lyics being exactly the same presents the problem. The best option would be to alter them more.

Nope you can't. Unless you can prove without a doubt that you wrote it first. Did you save it on your computer maybe. The date would show when it was written. Otherwise honey Green Day will flip you over and spank you pretty hard LOL.

i don't know u have no prof that u wrote it be for them so change some of the words don't let it sound the same or you well get sued i would just do that let me know how your band does

Bands do covers all of the time.........as long as you don't record the song and sell CD's with the song on it without permission, you're ok.

Chances are slim that you'll be signed so I wouldn't worry about too much. Did you copyright the song? No? Then you're screwed.
