I am going through a divorce with my husband of 2 years and he is also the father of my 8 month old daughter. I filed for a divorce after dealing with his drug problem for months and months. He refused to get help for the problem and lost 2 jobs in the proccess. He blew through all of our money and had to support his habit by borrowing money from other people, most of whom weren't the nicest people on the planet. I actually had people showing up at my door step all hours of the day looking for him and thier money. He has been arrested twice but never for drugs. I finally moved out when someone showed up looking for him after my daughter had been born. I have asked him to take a drug test before I allow him to see the baby, he has refused and has not seen her in about 4 months. I am requesting suppervised visitation and sole custody. My lawyer has advised me well but I was just wondering if there was anyone out there who has gone through something similar and what the outcome was.

Sounds like you should not have a problem getting the custody.
(And just WHY did you marry him???)

I've known a few couples who have gone through it. Through my line of work, I've encountered some of them. The drug addicts I've seen haven't gotten custody. The laws in each state are different, but, provided you're clean (I'm assuming you are), I'd say there's a pretty good chance you'll get your wish. But if he hasn't seen her in 4 months, he probably won't show up for visitation because he's probably off on a binge somewhere.

Want to know how to win custody, have proof of the drug problem, no court in any state would give a child over to a drug addict. Get witnesses any proof you can.

demand a drug test, then your daughter will be your custody

There is no way he will get custody of her.
