Honestly, I think if you are under 50 and you smoke, its your own dam fault. You die cancer, you made a stupid choice and are suffering consequences. I think every package cigarates should have a waiver to be signed.

I understand that what I'm doing is probably going to kill me early and that I will be saving society money by dying before I reach 70, even tho my last 5 years will be really expensive. I freely choose to smoke.

What does the age of 50 have to do with anything? We knew smoking was dangerous to our health back in the 70s. That gave you over 3 decades to get your act together and quit. There are no free passes in life for anyone!

We as smokers know the risks and continue of our own free will. The same as when we consume alcohol,eat fattening food,drive recklessly,and put something smaller than an elbow in our ear,etc..You would have to be completely insane to think any one owes you any thing to compensate for your own foolish behavior.The only thing that bothers me about the tabacco companies is that the increased amount of addictive substances added to their products continues to grow causing it to be harder to quit and grabbing new smokers to be addicted quicker. Also when every one does quit where is the money the government needs going to come from to cover the loss of that tax base? All other taxes will rise and the loss will be taken from every pocket in Canada. I smoke and am presently on my way to being in recovery.As with a drug addict or alcoholic I will always be in recovery from my cig addiction. Does any one owe me any thing? No,no,no!!!!! I choose to smoke, chose to continue for years,chose to light up again after I quit and will defend any anti-sue group. This country is going to become as sue happy as the U.S. if someone doesn't stop the crap. It is out right bullsh#t that any one would be allowed to claim that someone made them smoke!The only thing I would like to see is the Medical system cover the cost of one cessation program per smoker,one time only, and if that doesn't work than so be it they did their part and thats it.The products out there to help you quit are very expensive and not covered by most health plans, at least then the idiots out there screaming for the government to help them and blaming government for their problems will be appeased and the government can pat themselves on the back for thinking they did something.If you don't quit then thats your fault, not the government nor the tabacco companies,or any one else. Smoking is a choice and continuing to do so is a choice.It isn't easy to quit but ,I'm not saying that, but you can do it if you CHOSE too.

I'm on the fence on this one.

On one hand, I think most of the people here are right. How can you NOT know that cigarettes are bad for you? You learn it in school starting in kindergarten. So it is not a big secret. People are responsible for their own actions.

On the other hand, if people are responsible for their own actions, shouldn't the tobacco companies be responsible for theirs? They aggressively advertise their product, and direct those advertisements toward at-risk people through mediums that are easily assessible. Even with all the research that has proven the risks, they still attempt to play it down in the media. They make no effort to improve the safety of their product, and divert everyone's attention from the danger of the product by making empty gestures of "charity" to make it look like they are great guys. The fact is that cigarettes are ADDICTIVE and serve no practical purpose. They shouldn't even be legal, and the only reason they are is because the industry pays off the law makers.

You are held responsible for your actions in deciding to smoke in the first place by getting lung disease and cancer. So how are THEY supposed to be held responsible for THEIR actions?Legally, the only current way to do it is to sue their butts (pun intended).

i was reading a book that was written back in the late 1800's, it mentioned that smoking was not good for you. I dont know if they knew the exact reasons, but they knew that it caused problems. Of course, the life expectancy back then was less anyway, they were probably much more active which might have helped, and they didnt spend millions of dollars keeping old people alive on machines. I think that if you want to smoke that is ok, but when you need medical attention that can be traced to the activity, you either pay for it yourself or go home and cough your lungs out and die on your own dime. ps, you also must reimburse or take a paycut from any loss of work productivity also caused by smoking.

noone should be allowed to sue tobacco companys if your a idiot who smokes you can tell its bad for you when you wake up in the morning and spit up flem and have a hard time breathing when excerting yourself it dosent matter your age or if the tobacco company tells you its good or bad you know its not right believe me i smoked for 20 years and quit cold turkey i knew it wasnet right ..i feel so much better these last 5 yrs.

Smokers under 50 should stop smoking in the first place. Read the caution that is written on every cigarette package and tell me why smokers pay no heed to it and keep on buying cigarettes?

No. People have known for 30-40 years that smoking is harmful, and that it kills.

Allowing smokers to sue is like letting alcoholics sue beverage makers, or tennis players sue racquet manufacturers for tennis elbow.

Nobody should sue tobacco companies. For the same reason, nobody should sue fast food restaurants or Mrs. Field's cookies ( who constantly give free samples to entice people and don't even warn people how bad their cookies are for you).

No one should be able to sue tobacco comapnies. If you chose to smoke then that's up to you. It's like the fat people trying to sue McDonalds because they are fat, yet they still eat there everyday.

no one should be able to sue them for personal damages when its a choice, I can't sue Jim Beam for waking up with an ugly woman! You can't sue Viagra for your wife becoming pregnant, so why should we be able to sue a company whos product we buy of our own free will?
