Our local union has taken it upon themselves to change pharmacist tour duties. No one within the facility has complained and we have union and non-union memembers that do not want the union to change our tour. Can the union legally demand my tour of duty to change?

I do not see how the union can make non union employees do anything, but I would assume it is in the contract with the employer, so it probably isn't the union doing it but the employer. I assume you pay a fee to the union for not being in it?

Honestly, unions often times try to push the limits of their authority. If I were you, I would seek the counsel of a lawyer who specializes in labor law.

Good luck!

A grievance that is filed in my work place is aimed towards the employer. The union takes my grievance and similar ones (if it's a common complaint) to the employer on my behalf, although I may represent myself before the employer myself.

I don't know of unions unilaterally changing schedules. The employers would have had to give them that right (sounds nuts to me) otherwise the schedule has to be agreed upon by both employer and union.

If you are a non-union employee then the employer is the one who should complain to. Even if they gave the union the right to do what they wanted to with the tour of duty, the employer made that decision and should be responsible to you for it.

You mentioned that some union members wanted the same as you. If so, get them to stir trouble within the union with calls, letters, etc. Their bylaws may enable them to get a vote on the matter.
Good Luck

Peace

No you can not file a greivance. A union member also can not file a greivance on another union member. What is "tour of duty", hours?
Days per week?. duties?

the union cant force non union employees to do anything, however they can bend the arm of the employer and have them make the changes. and you cannot complain to the union if you are not a member. The unions have too damn much power.

as a non member no but the people in the union can use non members as an add in. Make sure that they bring up the fact that the public hates it. Also have them make a list signed by all non members that have a grievance
