Legally if you are married yes. It's typically uninforced though in the U.S. unless a criminal action is brought against you in a divorce court. If you are unmarried its a moral crime, not punishable by law. It's a crime against yourself, and it leaves you with no peace. It's better to clean up your relationship and give yourself a breather before entering into another one. You will be surprise how many successes are out there for those who choose to channel their energies into something constructive.

It is not a crime. In a civil divorce can be used to show the court what caused the divorce.

Not a crime, unless it is being used for divorce. Then the infidelity issue will come up. It is a morality issue I would think. I would condemn my husband to torture if he ever cheated.
